Terms of Service

These terms are a contract between you and New Wave Chair Company, doing business as New Wave Chair Co., 239 Main St Suite B, Destin, FL 32541 ("New Wave", "we"). By using newwavechairco.com or placing an order you agree to them, together with our Shipping & Returns, Warranty, Care, and Privacy pages, which form part of these terms. If you do not agree, please do not use the site.

An order is an offer to buy. We accept it when we send the order confirmation, and we may decline or cancel an order for any lawful reason — for example, a pricing or stock error, a fabric colour that has sold out, suspected fraud, or a shipping address we cannot serve. If we cancel after payment, we refund in full.

Prices, taxes, and shipping are shown in U.S. dollars and are confirmed at checkout. Tax is calculated from your shipping address. Shipping is the live carrier rate you select where rates are offered. The totals on your confirmation page are the authoritative amounts charged.

Chairs and umbrellas are sewn to the fabric colours you choose. Please check your configuration on the cart and review pages before placing the order; we begin cutting fabric once payment clears. Processing and delivery times are estimates set out on the Shipping & Returns page.

Payment is taken by card through Stripe when you place the order. If the payment step is not completed, the order is held and not produced; you can complete payment from your order-tracking link or we will contact you. We do not store card numbers.

Wholesale orders are quoted separately and are governed by the terms on the quote and the Wholesale page.

Delivery, risk of loss, and transit damage are covered by the Shipping & Returns page. Returns are covered by the Return Policy page (newwavechairco.com/returns): full-price items within 14 days of delivery, no returns on sale items. Defects are covered by the Warranty page. Those pages control if anything here appears to conflict with them.

• You must be at least 18 (or the age of majority where you live) to place an order.
• Provide accurate contact and delivery details; we are not responsible for deliveries to an address you entered incorrectly.
• Use the chair within its rated weight limit and follow the Care & Maintenance page; outdoor furniture left in storms or standing water can be damaged.
• Do not use the site to send spam, probe our systems, scrape content, or infringe anyone’s rights.

We try to describe and photograph products and fabric colours accurately, but colours vary by screen and by fabric lot, and hardwood grain is unique to every frame. If a difference matters to you, ask before ordering.

The New Wave Chair Co. name, logo, photography, video, and site content belong to us or our licensors. You may share links and use content for personal, non-commercial purposes; anything else needs our written permission.

EXCEPT AS EXPRESSLY STATED ON THE WARRANTY PAGE, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND WE DISCLAIM ALL OTHER WARRANTIES TO THE EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence.

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute that we cannot resolve informally will be brought in the state or federal courts located in Okaloosa County, Florida, and you consent to their jurisdiction.
